02/17/10 Update
Unfortunately, we are again forced
to defend ourselves due to the "Negative Marketing" and
less than reputable practices of a fellow competitors' numerous
and repeated assault on our reputation.
Be
it Known:
Tiger Performance Products, Inc. has been accused
of Cyber piracy and/or Cyber squatting by one of our competitors,
fortunately for not only us, but all entities using the
"helicopter helmet(s)" term. We are within our rights to market our
products, as this competitor is, in using this "generic term". In using
a "generic
descriptive term", it is not in the best interest of everyone involved in
this highly competitive industry to have this term Trademarked, which this
competitor has applied for as of February of 2009.
We have from
the beginning date of their application to present, monitored the proceedings
of our competitors' application. To date it this has not been approved and is
in the initial denial status for "Mark"
as being a "generic, descriptive term".
We shall continue to monitor
the progress of said application status until the final determination. At that
time we shall take the necessary measures to remain compliant with all ICANN
and affiliate regulations.

"Section
2(e)(1) Refusal to Register
The examining
attorney has considered the applicant’s arguments carefully
but has found them unpersuasive. The examining attorney
relies on the arguments and evidence previously made
of record that are incorporated by reference herein.
Accordingly, the refusal under Section 2(e)(1) is continued
and maintained."
As of
this date 02/17/2010 the application for Trademark Mark for
the term "Helicopter Helmets.com" by our competitor
has not been approved and is still in the application process,
with his revisions to his original
document pending. Again, we shall consistently monitor this
progress and take any and all actions necessary to remain
compliant.
I wish to thank our fellow competitors for the
vast support shown to us while we are involved in this debate that will
affect all of our future marketing decisions.
